Today, June 21, 2022 I was on a Zoom call for case number 1DSC-22-0000327 Rose Vs. Toodle-Flores. Kristine Yoo was the judge hearing the case.
During this call the judge ask if the defendant had been properly served which I responded yes. The defendant claimed that he had not been served and the judge decided to call the next case and wait so she could review the documents further. Upon her reviewing the documents she determined that I had s served the defendant and proof had been uploaded to the case.
The judge then goes on to say that she is going to set us up for mediation for this case as well as the case that the defendant filed against me.
I tried asking the judge if the mediation would be held via zoom as well and the judge began to come unhinged, being extremely unprofessional and disrespectful yelling over me and telling me to shut up.
I didn’t say anything and I let her get what she had to say off of her chest and then I proceeded to try and ask her again after she got done giving her instructions because she did not address whether or not the case would be heard from mediation via zoom. She then begins to scream and yell again being disrespectful and unprofessional. She then finally answers the question and says yes that it will be held via zoom however if I go to trial and we do not come to an agreement during mediation that I would need to be present.
I then very respectfully try to explain to her that my father passed away May 23 and that I am no longer residing on Oahu and she begins yelling again telling me to shut up.
She continues with her tirate being rude and disrespectful to the point where I end up hanging up the phone call because I am not going to allow her or anyone else to speak with me in the manner in which she did regardless of what position she holds with the State of Hawaii.
After disconnecting the car I called back to the civil service center and spoke with a young lady by the name of Natalie who was extremely apologetic for the judges actions and advised me that I should reach out to a Melanie May to file a report. After further investigating via the Internet I found that this is actually the email address and department in which you report a judge and their misconduct.
I also had asked Natalie how I can go about getting this judge removed from my case as I refuse to work with such a disrespectful individual.
There was absolutely no reason for this judge to come unhinged or tell me to shut up when I was simply asking a question. I was not speaking about any of the facts of the case however was merely trying to ask a question to make sure that I was in compliance with the court and that I made sure I knew what I needed to do. She however did not want to answer any questions.
